West Virginia electronic filing and service

Many firms involved in Mass Litigation cases in West Virginia have realized the value of paperless filings.  One thing that I have learned from working with the firms is that many firm members do not realize that a case can be placed on the LexisNexis File & Serve system for electronic service to the parties, even if the case in not online for electronic filing into the court.  You can take advantage of the same cost-saving benefits and convenience with File & Serve e-service, including no more photocopying and mailing (save some trees!).  All of your cases could be easily accessible to you with our online docketing and searchable repository of documents.

New 1/2 hr. web class added to the File & Serve roster!

File & Serve will now be offering a monthly 1/2 hr. web class on "Case & Party Management".  Learn how to request service list changes through the application so it remains updated.  This class will show how to add/delete parties & add/substitute attorneys.  Class dates vary, but the class time will be 12:00 noon (eastern).  Visit the Resource Ctr./Education & Training section in File & Serve for class dates and to register.  Upcoming dates are:  February 25 and March 25!

WV Raleigh County Circuit Court Implements Electronic Filing in the Flood Litigation

The West Virginia Mass Litigation Panel entered an order on Monday, June 29, 2009, designating the Flood Litigation pending in the Raleigh County Circuit Court for electronic filing and service.  The effective date will be July 20, 2009.

Pursuant to the order, litigation-specific training is mandatory for all case participants, even if a party has already attended training in other Mass Litigation cases.  LexisNexis is offering two types of litigation-specific web classes at no cost for participants interested in using File & Serve:

This is the third mass litigation in West Virginia to implement electronic filing & service.  In December, 2008, the Kanawha County Circuit Court implemented File & Serve in the asbestos personal injury and Digitek litigations.

Tracked Items: Monitor your cases and e-file and e-serve right from our Home Page

Did you know:  You can monitor activity in your case by setting up a Tracked Item?  To begin, sign on to File & Serve and click Tracked Items and then Tracking Setup.  Select the data items you would like displayed, i.e. Case History, File & Serve, etc.  Find your case by selecting your jurisdiction and entering part of the case name or number. Once set up is complete, you can click Tacked Items to view the Case History Report or to begin filing/serving into your case.

Attention Georgia E-Filers!!

Just a little friendly reminder...

When submitting your e-file transactions, there is no need to send courtesy copies to the court unless you've been requested to do so by the judge or court personnel.

As e-filing continues to be implemented in Federal and State courts, attorneys and law firm staff should consider more education on new local court rules

A May 6, 2009 article in Law.com about how different e-filing rules are from court to court and state to state (even courtroom to courtroom!) is a good reminder that in this era of technology, lawyers and staff should consider refresher education on local court rules and best practices for e-filing.

Everything from deadlines, to form and format, to what types of cases and documents are allowed is subject to be different with e-filing, and lawyers should proactively learn and prepare for the nuances so that there are no last minute rejections, or technical issues or other that could impact a filing's validity.

LexisNexis File & Serve can provide CLE courses around e-filing and service rules and nuances to help lawyers and staff understand some of the nuances.

Also, on LinkedIn, there is a group for sharing best practices around e-filing that people in the legal industry can join to stay abreast of e-filing news, best practices amongst vendors and users of e-filing. Join the group: "E-Filing/service of Court Documents".

There isn't likely a nationwide standard e-filing solution for all courts in our future.  So, it is best to prepare and learn about the changes in each court now and prepare your office for more e-filing requirements in the future.
