Class Action Lawsuit Filed Against Tween Inc.
Ohio Retailer of Popular Brands Justice and Limited Too Apparel Sued by Shareholders
A class action lawsuit on behalf of all public shareholders has been filed against Tween, Inc., and its Board of Directors, in Delaware. The action is in response to the June 25, 2009 announcement of Tween’s proposed acquisition by New York based womens apparel specialty retailer Dress Barn, Inc. Shareholders contend that the all-stock offer announced in June undervalues the Tween share price, and could further erode shareholder value based upon provisions in the agreement, including Dress Barn’s own share performance.
Cheryl Dutiel vs. Tween Brands, Inc. et al. was filed on July 17 in the State of Delaware, Court of Chancery. The documents filed in these cases are available online at LexisNexis® File & Serve.
