Delaware Superior Court expands to New Judgment Cases beginning Jan. 1 2010!

Exciting things are happening in Delaware!

Per President Judge Vaughn's Administrative Directive No. 2009-4 effective January 1, 2010, all newJudgment cases filed with the Prothonotary in any county shall be filed electronically using the LexisNexis® File & Serve eFiling system.  To file a new Judgment case select the "Civil-Judgments" case class.

Training

LexisNexis® File & Serve web-based training is available during any of the regularly scheduled eFiling classes and the below special web classes have also been scheduled for Superior Court Judgment case filers.

Important Reminders from the Superior Court Prothonotary's Office - Applies to ALL Superior Court Cases

• Choice of Main/Supporting documents must be done properly.  i.e., the Motion is the Main document; the notice, proposed order, cert of service, and any other documents are the supporting documents.
• Document titles MUST be specific and not abbreviated.  i.e., Plaintiff Mary Jones Motion for Summary Judgment
• Document titles should be in ALL CAPS
• Do not repeat the case caption in the document title
• The Proposed Order document title must be very specific.  i.e.  Plaintiff Sally Smiths Proposed Order for Summary Judgment
• Per Delaware Supreme Court Rule 12(a) in order to file a pleading the filer must be an active member of the Delaware Bar and must "maintain an office in Delaware for the practice of law."

Delaware Court of Chancery Uses File & Serve to Improve Efficiency of Court’s Workflow and Help Delaware Attorneys Better Serve Clients

The Delaware Court of Chancery is widely recognized as the nation’s preeminent forum for the determination of business disputes. The Court has official jurisdiction to hear and determine all “matters and causes in equity” involving businesses with legal standing in the state of Delaware. In light of the fact that more than 50% of U.S. public corporations—including 60% of Fortune 500 companies—are incorporated in the state of Delaware, the reality is that the Court of Chancery handles litigation involving thousands of corporations and other business entities through which a vast amount of the world’s commercial affairs are conducted.

As with other courts in the U.S., the Delaware Court of Chancery experienced a significant rise in litigation in the 1980s, which continued to escalate into the 1990s. The Court of Chancery officials decided it was time to make a change in their manual system of paper filings.

"The paper filing of documents for the cases in our docket had just become overwhelming for us to manage, both in terms of the workload requirement for the court clerks and the storage requirements for the physical files,” said Chancellor William Chandler. “I met with the vice chancellors to discuss what would be involved with making a switch to electronic filing.”

The Court of Chancery selected File & Serve from LexisNexis® and designated it as the official e-filing service for certain categories of document-intense corporate litigation filed with the Court. According to Chancellor Chandler, the benefits realized from the implementation of File & Serve were vast and immediate. more

WV Mass Litigation Celebrates One Year Anniversary with LexisNexis File & Serve

EBay Inc. v. Craigslist Inc.: Ownership Battle to be aired in DE Court of Chancery

The trial in an ownership dispute between internet giants EBay and Craigslist, which is being litigated in the Delaware Court of Chancery, began on Monday, Dec. 7, 2009.

West Virginia Ohio County Circuit Court Implements Electronic Filing & Service In Re: Tobacco Personal Injury Litigation

We are pleased to announce that the West Virginia Mass Litigation Panel is implementing electronic filing using LexisNexis File & Serve for the Tobacco Personal Injury Litigation pending in the Ohio County Circuit Court. Effective December 11, 2009, the West Virginia Mass Litigation Panel orders that all cases in the Tobacco Personal Injury Litigation are subject to e-filing and service as outlined in the November 20, 2009 Order Designating Tobacco Litigation for Electronic Filing and Service. Electronic service has been in effect since August 31, 2009.

In order to make the transition to electronic filing as seamless as possible, we are offering training highlighting the differences between e-service and e-filing in the West Virginia Tobacco Litigation. Training for the Tobacco Litigation is mandatory for participants. The following training classes are provided free of charge for attorneys and staff members and are offered via the web. We will be offering several 60 minute web based training classes called Transition to E-filing for the West Virginia Tobacco Personal Injury Litigation. Below is a list of the available web based class dates/times:

• Thursday, Dec 3 @ 10:00-11:00 AM EST

• Monday, Dec 7 @ 2:00-3:00 PM EST

• Wednesday, Dec 9 @ 10:00-11:00 AM EST

How to Register for Training

To register for the web classes, sign into File & Serve and click on the Resource Center link at the top right hand side of the screen. Simply scroll to the Education and Training section of the page and choose West Virginia from the drop down list. Click on the title of the class you would like to attend and fill in the requested information. Once you have registered, you will receive a confirmation email with the website address and toll free number to call.
