135 Yamaha Product Liability Cases To Be Heard in Orange County
A series of product liability lawsuits filed in California courts against ATV manufacturer, Yamaha Motor Corporation USA, will be using LexisNexis® File & Serve for electronic document delivery in the litigation.
The California cases have been consolidated into Judicial Council Coordinated Proceeding No. 4561 and will be heard by Orange County Superior Court Thierry Patrick Colaw.
First introduced to the U.S. market in 2003, Yamaha’s off-road Rhino® became one of its best selling all terrain utility vehicles. Popular with both children and adults, all terrain vehicles are marketed for sport and utility purposes. While reports of all terrain and utility terrain vehicle injuries and deaths have been steadily climbing since 1986, the Consumer Products Safety Commission specifically began investigating the Rhino® in 2008 due, in part, to the high number of product liability suits filed against the manufacturer. In 2009 the Consumer Products Safety Commission announced its findings in more than 50 incidents involving 46 driver and passenger deaths, resulting in a recall of the entire Rhino® product line – more than 146,000 vehicles produced since 2003. Nationwide, related lawsuits have been filed in many other state and federal jurisdictions.
The U.S. Judicial Panel on Multidistrict Litigation consolidated and transferred the federal cases to the Western District of Kentucky (Louisville Division) for hearing in February.
A consolidated action of Georgia lawsuits against the same manufacturer is also using LexisNexis® File & Serve.
